Marketplace Terms & Disclaimer
These terms are intended to make the role of USAviation.info clear: we provide classified advertising space. We do not conduct, broker, guarantee or supervise transactions between users.
Important — buyers must conduct their own due diligence
USAviation.info does not independently verify and does not guarantee the identity or authority of any seller or buyer; ownership or title; registration status; condition; airworthiness; maintenance history; damage history; logbooks or records; liens or encumbrances; specifications; serial numbers; pricing; location; availability; authenticity; legality; regulatory compliance; or any other representation contained in a Marketplace listing.
1. Classified advertising platform only
USAviation.info is not a seller, buyer, aircraft dealer, broker, agent, escrow service, payment processor, title company, appraiser, inspector, mechanic, repair station, attorney, tax adviser, insurer or party to any transaction between Marketplace users. USAviation.info does not take possession of listed property and does not transfer funds, title or ownership.
2. Seller responsibility
Sellers are solely responsible for the content, accuracy, completeness, legality and representations contained in their advertisements. By submitting a listing, a seller represents that the seller is authorized to advertise the item and has the right to provide and license the photographs and other material submitted for display on USAviation.info.
3. Buyer responsibility and due diligence
Buyers are solely responsible for independently investigating every listing and every proposed transaction. Appropriate diligence may include verifying seller identity and authority, ownership and title, FAA or other registration records, liens and encumbrances, aircraft logbooks and maintenance records, damage history, serial numbers, specifications, airworthiness, condition, location, import/export requirements, taxes, regulatory compliance and any other information material to the transaction. Buyers should use qualified aviation inspectors, mechanics, title/escrow services, attorneys, tax advisers and other professionals when appropriate.
4. Transactions are at the users' own risk
Users communicate and transact directly with one another and entirely at their own risk. USAviation.info does not endorse any seller, buyer, listing, aircraft, product, service or transaction. To the fullest extent permitted by applicable law, USAviation.info is not responsible for fraud, misrepresentation, non-delivery, non-payment, payment disputes, title defects, liens, regulatory violations, property damage, personal injury, lost profits, consequential losses or other damages or disputes arising from Marketplace activity. Nothing in these terms excludes any liability that cannot legally be excluded.
5. No warranties
Marketplace content and services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, USAviation.info disclaims warranties regarding listings, sellers, buyers, products, aircraft, services, availability, accuracy and fitness for a particular purpose.
6. Review, Trusted Sellers and removal
USAviation.info may review, approve, reject, suspend, edit for formatting, or remove listings at its discretion. Most new seller listings are held for review before publication. USAviation.info may designate selected established sellers as Trusted Sellers, allowing their Standard Listings to publish immediately without individual pre-publication approval. Trusted Seller status may be changed or revoked at any time. Approval, Trusted Seller status, or auto-publication does not constitute verification, certification, endorsement, inspection or a guarantee of any listing or seller.
7. Listing duration
Active listings are displayed for 30 days unless sold, removed, suspended or otherwise taken down earlier. Sellers may reactivate an unchanged expired listing from their account. Material edits by standard sellers may return a live listing to approval review; Trusted Seller Standard Listings may republish immediately. Marketplace Featured and Homepage Featured placement remain separately controlled by USAviation.info.
8. Safety and prohibited content
Users may not submit fraudulent, unlawful, misleading, infringing, stolen, unsafe or otherwise prohibited items or content. Pornographic content is strictly prohibited. Any account that submits or attempts to publish pornographic content will be immediately suspended, the content will be blocked or removed from USAviation.info, and the account will be barred from further use of USAviation.info. USAviation.info may also suspend or remove other accounts, listings or content when necessary to protect the Marketplace or comply with legal obligations.
